H-2a Program Adverse Effect Wage Rate for 2018

UPDATE 12/22/17: As anticipated, DOL released AEWRs for the H-2a sheepherder program and for other special procedures H-2a users on December 22.  You can view the Federal Register notice at this link.

The U.S. Department of Labor (DOL) published the Adverse Effect Wage Rates (AEWRs) for the H-2a temporary or seasonal non-immigrant agricultural worker visa program in the Federal Register on Dec. 21.  California's 2018 AEWR will be $13.18 per hour.

For the first time, the DOL is allowing a 2 week delay in the effective date of the AEWR; the 2018 AEWRs will be effective on Jan. 4.  In past years, AEWRs have been effective on the date of publication (usually in mid-to-late December) creating logistical difficulties for H-2a employers who were frequently obliged to implement a change in the hourly wage rate for H-2a workers in mid-payperiod.

DOL is expected to publish the 2018 AEWR for sheepherders and other H-2a special procedure users in the Federal Register on Dec. 22 to be effective on Jan. 1.
