Fresno Superior Court Dismisses AB 1513 Constitutional Challenge

The Superior Court in Fresno has dismissed a constitutional challenge to AB 1513's non-productive time back pay requirements for piece-rate work.  The case filed by Nisei Farmers League alleged that AB 1513 is unconstitutional because the terms in the statute "other non-productive time" and "actual sums due" are unconstitutionally vague.  The Court also rejected the plaintiff's argument that AB 1513 violates due process requirements because it provides for retroactive back wage payments.

The Court's decision leaves AB 1513 intact with no change likely to the AB 1513 process prior to the final December 15, 2016 deadline for back wage payments.
