UPDATED: DIR Conducting Review of FLC Exams

UPDATE: On Saturday, October 15, DIR announced it will resume offering FLC licensing examinations, including examinations for licensed FLCs seeking license renewal and those seeking initial licensure.  DIR indicated all those waiting to take the FLC exam will be notifed by mail and receive examination instructions within 7-10 business days.

In September 14, Farm Employers Labor Service received the following message that could be of interest to FELS Newsletter subscribers, both those who are farm labor contractors and those who employ the services of farm labor contractors.  As you probably know, many FLCs have struggled in recent months with both DIR’s licensing processes and the process of registration with the U.S. Department of Labor.  Ms. Huber spoke with the California Farm Bureau’s Agricultural Employment Policy Advisory Committee in March of this year.

Dear FLC Partner:

 In mid-August, we learned that there may have been errors in some of the Farm Labor Contractor (FLC) examinations that were administered beginning in December 2021. As a result, we began auditing the examinations administered by our office from December 2021 through August 19, 2022. We have temporarily suspended administration of the examinations while we review the examinations.

This is to notify you that we are continuing to prioritize completion of exam audits and issuing temporary or permanent licenses to affected contractors. We are also working diligently to resume FLC examinations. We will provide further updates as they become available.

 Please note:

  • Reviews are being conducted for exams which may have been impacted
  • These reviews are automatic and FLCs do NOT need to request a review from DLSE.
  • This applies to exams taken in both English and Spanish.
