2024 FELS Employment Compliance Notices California Postings Books and Laminated Posters Available Soon

Farm Employers Labor Service will make Employment Compliance Notice products available soon. Agencies are still revising their postings in the new year, and each year we wait until we are sure we have as many of the revised 2024 postings as possible. We hope to have posters and books ready to ship after January 15, 2024.
Recent regulatory developments have required us to reconfigure our products for 2024. We recently learned of guidance from the U.S. Department of Labor indicating their view that notices they require may not be furnished by an employer in a book or binder. At the same time, the California Labor Commissioner’s guidance clearly indicates they find it acceptable for employers to furnish notices they require in a book or binder, particularly for construction or agricultural worksites.
FELS has always, and still does, offer assurance that to the best of our understanding use of our Employment Compliance Notice products offers California agricultural employers all the notices they are required to furnish to employees in the most convenient form possible. Many of these notices are translated into Spanish and are formatted to appear alongside the English version or on facing pages, giving agricultural employers the ability to furnish notices in both English and Spanish. Other providers of postings often offer their postings with English and Spanish on opposite sides of the same poster; we believe our products are superior for California agricultural employers who commonly employ people who may not be comfortable with written notices in English.
To align our products with U.S. Department of Labor guidance, we are now offering Employment Compliance Notice postings in two kits; either of these kits will allow California agricultural employers to furnish all notices they are required to by California and federal law; one of these kits furnishes all California notices in the same spiral-bound 11” x 17” book format we have offered in past years, with two additional laminated posters for federal notices. The other kit offers all federal and California notices on five posters in our familiar laminated, 27” x 38” poster format.
We also took the opportunity to ensure all our notices are furnished in accordance with any minimum poster size or font size stipulated by the mandating agencies’ guidance, even though we are aware of no instances in which those agencies have penalized employers for providing notices outside those guidelines. As a result, required notices that in past years occupied four posters now require five posters.
We have opted to offer the California Department of Pesticide Regulation’s Forms A-8 (Handler Safety) and A-9 (Farmworker Safety) as a separate poster and no longer part of any package of posters or as part of the new California Employment Compliance Notices book. This will allow our customers to comply with pesticide safety posting notices as they may be required to do based on the activities of their particular agricultural operations.
To summarize, for 2024 FELS Employment Notifications products are:
- Employment Notifications Posting Kit #1: California Employment Notifications Book (spiral-bound book)+Laminated Federal Employment Notification Posters: 11"X17" spiral-bound book containing required California state notifications along with two laminated posters containing federally-required postings.
- Employment Notifications Posting Kit #2: Laminated Employment Notifications Federal+State Posters set of five laminated posters.
- California Department of Pesticide Regulation Form A-8 (Handler Safety) and A-9 (Farmworker Safety) (English & Spanish): CA Dept. of Pesticide Regulation postings must be displayed at work locations and used in fieldworker and handler training.
We recognize that the Employment Notifications spiral-bound book has been a popular alternative to wall-hung posters, particularly as the number of posters required has grown from four a few years ago to five today. We created the Employment Notices book a few years ago to satisfy that demand for convenience. We regret that the guidance of the U.S. Department of Labor effectively prohibits us from continuing to offer that popular product. We believe furnishing these two kits, priced at $200 each, will be an affordable, convenient, and effective means for California agricultural employers to meet their employee notices obligations under federal and state law.
